All other names, logos, product and service names, designs, and slogans on this Website are the trademarks of their respective owners.

You may use the Website only for lawful purposes and in accordance with these Terms of Use. You agree not to use the Website:

  • In any way that violates any applicable federal, state, local, or international law or regulation (including, without limitation, any laws regarding the export of data or software to and from the US or other countries).

  1. Goods and/or services offered. We use our website to sell physical gift cards, virtual gift cards, branded & non-branded merchandise, amenities such as gift baskets for delivery to guest rooms, and prepared food available for pick-up at one or more of our restaurant locations.
  2. Secure, Encrypted Checkout. Our checkout processes, and our entire website at RiverCourse.com, are secured with 256-bit SSL encryption.
  3. Credit Card Information. Your credit card information is never stored on our servers. Our checkout processes are regularly audited by our payment processors to ensure PCI compliance.
  4. Order Acceptance and Cancellation. You agree that your order is an offer to buy, under these Terms of Use, all products and services listed in your order. All orders must be accepted by us or we will not be obligated to sell the products or services to you. We may choose not to accept orders at our sole discretion, even after we send you a confirmation email with your order number and details of the items you have ordered.
  5. Prices and Payment Terms.
    1. Prices posted on this Site may be different than prices offered by us at the resort or other locations. All prices, discounts, and promotions posted on this Site are subject to change without notice. The price charged for a product or service will be the price in effect at the time the order is placed and will be set out in your order confirmation email. Price increases will only apply to orders placed after such changes. Posted prices may not include taxes or charges room delivery. All such taxes and charges will be added to your merchandise total, and will be itemized in your shopping cart and in your order confirmation email. We strive to display accurate price information, however we may, on occasion, make inadvertent typographical errors, inaccuracies or omissions related to pricing and availability. We reserve the right to correct any errors, inaccuracies, or omissions at any time and to cancel any orders arising from such occurrences.
    2. We may offer from time to time promotions on the Site that may affect pricing and that are governed by terms and conditions separate from these Terms of Use. If there is a conflict between the terms for a promotion and these Terms of Use, the promotion terms will govern.
    3. Terms of payment are within our sole discretion and, unless otherwise agreed by us in writing, payment must be received by us before our acceptance of an order. We accept Visa, MasterCard, American Express, Discover, and Diners Club, cards for all purchases. You represent and warrant that (i) the credit card information you supply to us is true, correct and complete, (ii) you are duly authorized to use such credit card for the purchase, (iii) charges incurred by you will be honored by your credit card company, (iv) you will pay charges incurred by you at the posted prices, including shipping and handling charges and all applicable taxes, if any, regardless of the amount quoted on the Site at the time of your order, and (v) you authorize us to charge your payment method the stated amount.
  6. Returns and Refunds. Except for any products designated on the Site as final sale or non-returnable. Refunds are processed within approximately three business days of our receipt of your merchandise. Your refund will be credited back to the same payment method used to make the original purchase on the Site. WE OFFER NO REFUNDS ON ANY PRODUCTS ON THIS SITE NOT DESIGNATED AS REFUNDABLE OR RETURNABLE.
  7. Cancellations and Changes to Orders. Our order cancellation, order change, shipping policies, and contact information vary by product category as noted below:
    1. Tee Time Reservations.
      1. Changes and Cancelations. At least 24 hours notice must be given to cancel or make changes to your tee time. If the change or cancellation is not made within 24 hours, the credit card holder will be held responsible for all players in the group and charged a no-show fee which is 50% of total reservation costs. All changes and cancellations should be made promptly by calling the Golf Shop at (805) 688-6042.
    2. For any product or service not specified, you may contact us using information noted at the end of these Terms of Use
  8. Taxes. All product and service purchases made through the Site are subject to a 7.75% local sales tax, which will be applied at the time of purchase. Tee Time Reservations, are NOT subject to local sales tax.

23. Indemnification

The limitation of liability set out above does not apply to liability resulting from our gross negligence or willful misconduct.

26. Governing Law and Jurisdiction

You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

27. Arbitration

You and we agree that any dispute, claim or controversy arising out of or relating to this Agreement or the breach, termination, enforcement, interpretation or validity hereof or the Use of the Site or regarding Communications or Claims (collectively, “Disputes”) will be settled by binding arbitration, except that each party retains the right: (i) to bring an individual action in small claims court, and (ii) to seek injunctive or other equitable relief in the California state courts (as defined below) to prevent the actual or threatened infringement, misappropriation or violation of a party’s copyrights, trademarks, trade secrets, patents or other intellectual property rights (the action described in the foregoing clause (ii), an “IP Protection Action”).

The arbitration will be administered by the American Arbitration Association (“AAA”) in accordance with the Commercial Arbitration Rules and the Supplementary Procedures for Consumer Related Disputes (the “AAA Rules”) then in effect, except as modified by this “Dispute Resolution” section. (The AAA Rules are available at www.adr.org/arb_med or by calling the AAA at 1-800-778-7879.) The Federal Arbitration Act will govern the interpretation and enforcement of this Section.
  3. Time Limit
    You agree that regardless of any statute or law to the contrary, you must submit any Disputes for arbitration within one (1) year after such claim or cause of action arose or be forever banned.

28. Waiver and Severability

No waiver by the Company of any term or condition set out in these Terms of Use shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of the Company to assert a right or provision under these Terms of Use shall not constitute a waiver of such right or provision.

If any provision of these Terms of Use is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms of Use will continue in full force and effect.

The Terms of Use and our Privacy Policy constitute the sole and entire agreement between you and River Course at the Alisal regarding the Website and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Website.

3. How Do We Collect Your Information?

We collect data from you in different ways. Some of them are direct (for example when you sign up for our newsletter). Others are by visiting the Site or interacting with us even without having an account (such as through social media). Cancellations and Changes to Reservations

Changes and Cancellations. At least 24 hours notice must be given to cancel or make changes to your tee time. If the change or cancellation is not made within 24 hours, the credit card holder will be held responsible for all players in the group and charged a no-show fee which is 50% of total reservation costs. All changes and cancellations should be made promptly by calling the Golf Shop at (805) 688-6042.
